Good article. Steve. Your comments on "near but not high" and "high but not near" are spot-on. I remember playing with black kids when I was in elementary school in Waynesboro GA. It never occurred to me to question why I never saw them in the school which was within walking distance for all of us. I also remember the racial unrest during the brief time I was stationed near Boston about 55 years ago. A lot of parents were upset at the time because of measures being taken to integrate schools which were not segregated by law - but by white flight.
I disagree that courts are bound to dictate how the government acts against non-citizen residents. The courts are bound to ensure that any executive branch proceedings against non-citizens are in accordance duly enacted laws.
