“As I’ve said in the past, if you like what Trump is doing, just imagine Democrats doing it to you because eventually, they will.”
MAGA supporters really should remember this. When some future Dem admin does something you really don’t like, just remember your philosophical position of April 2025 just so we can be spared your intellectual inconsistencies in the future.
I suspect Shipwrecked Crew is more knowledgeable on these issues than any of us opining here. It might pay to read his take and compare it to our preferred sources.
“The president may invoke the Alien Enemies Act in times of “declared war” or when a foreign government threatens or undertakes an “invasion” or “predatory incursion” against U.S. territory.”
“The president has inherent authority to repel these kinds of sudden attacks — an authority that necessarily implies the discretion to decide when an invasion or predatory incursion is underway.”
There was an administrative error in sending an illegal alien to El Salvador where he was evidently a wanted man. There was a final order for his removal in place until a judge interfered and gave him protection against deportation.
I’m at a loss to understand why anyone who makes a big deal of a poorly handled Signal chat would advocate for personnel with no continuous need to know to have Top Secret clearances and unfettered access to government offices
Bottom line is we can’t have 650 or more judges in 94 Federal Court Districts taking over policy making from the Executive Branch.
You're correct on the law and it should be self-evident why judges are enjoining the Administration's actions. There is no declared war or invasion by a foreign government.
I'd put "error" in quotation marks. I haven't seen any reports of him being wanted in El Salvador but the material facts are that he was a lawful asylum-seeker here and was not supposed to be deported. The lack of due process and the fact that Trump is in such an all-fired hurry to deport people is the problem, as well as the Administration's disinterest in following the law or making their mistakes right.
As to your last two paragraphs, I'm scratching my head. Judges and Congress have constitutional roles to play in making sure that presidents don't run afoul of the law. That's why MAGA doesn't like them.
So you choose to ignore the part of the law that necessarily implies the President has the discretion to decide when an invasion or predatory incursion is underway.
Regarding last two paragraphs. I failed to make sure you knew I was talking about law firms and former government officials not having a continuous need to know. Also, there should not be 650 judges who can countermand the President's or the Congress' authority without the Supreme Court's concurrence.
I'll quote again from the link above. You may consider it a reading comprehension test or argue it's plain language meaning.
"The president may invoke the Alien Enemies Act in times of “declared war” or when a foreign government threatens or undertakes an “invasion” or “predatory incursion” against U.S. territory. The Constitution gives Congress, not the president, the power to declare war, so the president must wait for democratic debate and a congressional vote to invoke the Alien Enemies Act based on a declared war. But the president need not wait for Congress to invoke the law based on a threatened or ongoing invasion or predatory incursion. The president has inherent authority to repel these kinds of sudden attacks — an authority that necessarily implies the discretion to decide when an invasion or predatory incursion is underway."
Could be one or more. The President has claimed it was Venezuela that took advantage of Joe Biden's open borders policy to send their criminal gangs to the USA. Biden facilitated this with an application program to do exactly that.

There’s a thin line between pro-Hamas and pro-Palestine but both are generally expressions of anti-Semitism.

Which foreign government has invaded us, which is inherently an act of war?

"A foreign government": which one?
